I believe that they delegate the responsiblity to the creator
of the CD and act on good faith.

No, but ISP also cannot do this.
At least in Germany they only need to do their best to ensure
that they do not violate copyright.  So checking the source
(of the CD) and some toplevel file names certainly offers some
protection.
